PERSONAL INFORMATION WE COLLECT

When you visit the site, we automatically gather certain details about your device. This includes information about your web browser, IP address, time zone, and some of the cookies installed on your device. As you navigate the site, we also collect data about the specific web pages or products you view, the websites or search terms that directed you to our site, and how you interact with it. We refer to this automatically-collected information as “Device Information”.

We collect Device Information using the following technologies:

When you make a purchase or attempt to make a purchase through the site, we collect specific information from you. This includes your name, billing address, shipping address, payment details (including credit card numbers), email address, and phone number. We call this “Order Information”. In this Privacy Policy, when we mention “Personal Information”, we mean both Device Information and Order Information.

Klarna

In order to offer you Klarna’s payment options, we will share certain aspects of your personal information, like contact and order details, with Klarna. This is so Klarna can assess if you qualify for their payment options and customize them for you.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We generally use the Order Information we collect to process any orders placed through the site. This involves handling your payment information, arranging shipping, and providing you with invoices and/or order confirmations. Additionally, we use this Order Information to:

  • Communicate with you;
  • Screen our orders for potential risks or fraud;
  • When in line with your shared preferences, provide you with information or advertising related to our products or services.

We use the Device Information we collect to help identify potential risks and fraud (especially your IP address), and to enhance and optimize our site. For example, by generating analytics on how our customers browse and interact with the site, and evaluating the success of our marketing and advertising campaigns.

Facebook pixels are also utilized.

SHARING YOUR PERSONAL INFORMATION

We share your Personal Information with third parties to assist us in using your Personal Information as described above. For instance, we use Shopify to power our online store. Finally, we may share your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other legal requests for information, or to protect our rights.

DO NOT TRACK

Please note that we do not change our site’s data collection and use practices when we receive a Do Not Track signal from your browser.

YOUR RIGHTS

If you are a European resident, you have the right to access the personal information we hold about you and to request that it be corrected, updated, or deleted. If you wish to exercise this right, please contact us using the contact information below.

Also, if you are a European resident, we note that we process your information to fulfill contracts with you (for example, if you make an order through the site), or to pursue our legitimate business interests as listed above. Additionally, please be aware that your information will be transferred outside of Europe, including to Canada and the United States.

DATA RETENTION

When you place an order through the site, we will keep your Order Information for our records unless you ask us to delete it.

ANIMAL WELFARE POLICY

OceanusSwim products do not use any materials that involve the slaughter or harm of animals. We oppose animal cruelty.

SUBSTAINBLE SOURCING

OceanusSwim aims to be as sustainable as possible. We source our eco-friendly recycled lycra. OceanusSwim packaging is also reusable and made from recycled paper. We use all our scrap fabrics to create accessories.

Professional Code of Conduct:

Be patient and courteous. Be inclusive. We welcome and support people of all backgrounds and identities. This includes, but is not limited to members of any sexual orientation, gender identity and expression, race, ethnicity, culture, national origin, social and economic class, educational level, color, immigration status, sex, age, size, family status, political belief, religion, and mental and physical ability.

Be considerate. We all rely on each other to produce the best work as a company. Your decisions will impact clients and colleagues, and you should consider these consequences when making decisions.

Be respectful. We won't always agree, but disagreement is not a reason for disrespectful behavior. We will all experience frustration at times, but we must not let it turn into personal attacks. An environment where people feel uncomfortable or threatened is not productive or creative.

Choose your words carefully. Always conduct yourself professionally. Be kind to others. Do not insult or belittle others. Harassment and exclusionary behavior are unacceptable. This includes, but is not limited to:

  • Threats of violence.
  • Discriminatory jokes and language.
  • Sharing sexually explicit or violent material via electronic devices or other means.
  • Personal insults, especially those using racist or sexist terms.
  • Unwelcome sexual attention.
  • Advocating for, or encouraging, any of the above behavior.

Do not harass others. Generally, if someone asks you to stop something, then stop. When we disagree, try to understand why. Differences of opinion and disagreements are mostly inevitable. What matters is that we resolve them constructively. Our differences can be our strengths. We can find strength in diversity. Different people have different perspectives on issues, and that can be valuable for solving problems or generating new ideas. Not understanding why someone holds a viewpoint doesn't mean they're wrong.

Don't forget that we all make mistakes, and blaming each other doesn't help. Instead, focus on resolving issues and learning from mistakes.

Ethical Trading Policy

All our suppliers must comply with all laws relevant to their business. They are expected to adhere to the principles of the United Nations Global Compact, UN Declaration of Human Rights, and the 1998 International Labour Organisation’s “Declaration on Fundamental Principles and Rights at Work” in accordance with law and practice.

OceanusSwim is committed to trading relationships that are both commercially and ethically viable. We support fair trade and only work with suppliers and manufacturers who comply with our ethical trading policy. We will evaluate these suppliers against the following standards.

This policy outlines the minimum labour standards we expect our suppliers to meet:

  • There is no forced labour.
  • Child labour is not used.
  • No racial or sexual discrimination is practiced.
  • Working hours comply with local national standards.
  • Wages meet the minimum local standards.
  • Human and civil rights are respected.
  • Bribery either to customers or from suppliers is not acceptable.

Forced, bonded or involuntary labour

Any work or service that is extracted from a person under the threat of a penalty or where they have not entered voluntarily into an employment contract. Examples include slave or indentured labour, bonded labour, involuntary labour, involuntary or unpaid prison labour. Workers should not be required to lodge “deposit” or their identity papers with their employer and are free to leave their employer after reasonable notice.

Child labour

A child is defined as any person less than 15 years of age unless local minimum wage law stipulates a higher age for work or mandatory schooling, in which case the higher age applies. If local minimum age law is set at 14 years of age in accordance with developing country exceptions under ILO Convention138, the lower will apply.

Children may only be employed in circumstances that fully protect them from potential exploitation, protect them from moral or physical hazard and long term damage to health, and do not disrupt their education.

Discrimination

Discrimination is treating a worker/prospective worker less favorably than any other worker/prospective worker in relation to hiring, compensation, access to training, promotion, termination or retirement on the grounds of their race, caste, national origin, religion, disability, gender, sexual orientation, union membership political affiliation or age.

Working Hours

Working hours must comply with the national laws and benchmark industry standards, whichever offers greater protection. Workers should not be required to work more than 48 hours per week (or less in accordance with local/national laws); should not work more than 12 hours of voluntary overtime; and should get one day off in 7. Overtime should not be demanded on a regular basis and should always be compensated at a premium rate. Where the company is party to a collective bargaining agreement freely negotiated with worker organizations it may require overtime work in accordance with the agreement to meet short term demand.

Remuneration

Workers should be paid at least the national/local minimum wage for a basic working week and this should be sufficient to cover basic needs and allow some discretionary income. All workers should be provided with written and understandable information about their pay before they start employment and should be given a pay slip or other understandable information about their wages for the pay period concerned each time that they are paid.

Human and Civil Rights

Workers are free to join a trade union of their choice and to bargain collectively on wages, benefits and working conditions without fear of harassment or intimidation. Workers’ representatives are not discriminated against and have access to carry out their representative functions in the workplace. Where the right to freedom of association and collective bargaining is restricted under law, the employer facilitates, and does not hinder, the development of parallel means for independent and free association and bargaining. Unacceptable disciplinary practices such as those based on corporal punishment, physical or mental coercion, verbal abuse or deducting money from wages due to a worker will not be tolerated in any form. Workers will be free from abuse, the threat of physical abuse, sexual or other harassment and verbal abuse or other forms of intimidation are not allowed.

Bribery

Bribery is the practice of offering something (money, gifts, hospitality or services) in return for or in expectation of more favorable treatment. Suppliers must conduct their businesses in an ethical manner and must not seek to gain competitive advantage by means of unethical or dishonest practices including without limitation; bribery, corruption, kickbacks, the provision of gifts, favours or services.

CHANGES

We may update this privacy policy from time to time to reflect changes in our practices or for other operational, legal or regulatory reasons.
